Chapter 1 · Constitutional Architecture & Jurisdictional Scope

Common Law in the UAE: Constitutional Carve-Out

Episode 01.1 · DFSA Compliance Series

About this episode

How does a common law financial free zone exist inside a civil law country like the UAE?

It starts with Article 121 of the UAE Constitution and Federal Law No. 8 of 2004, which exempt the DIFC from UAE federal civil and commercial law in favour of English common law. Federal criminal law — including AML legislation — still applies, and disputes are resolved by the DIFC Courts.
